1. DEFINITIONS

COMPANY or SUPPLIER means the company Ecarcharger Ltd.
SITE or INTERNET STORE or ONLINE STORE means the website LuxuryChess.eu and its subdomains.
CLIENT or USER or CONSUMER means any person using the website LuxuryChess.eu
PERSONAL DATA means personal data within the meaning of the Personal Data Protection Act (PDPA).
CASH ON DELIVERY means cash on delivery within the meaning of the Postal Services Act.
CPA means the Consumer Protection Act.
PDPA means the Personal Data Protection Act.

Ecarcharger Ltd. shall hereinafter be referred to for short as LuxuryChess.eu

3. GENERAL PROVISIONS

This document constitutes the general terms and conditions for the use of the website LuxuryChess.eu, which regulate the rules, rights, obligations, and restrictions when using LuxuryChess.eu, including the conclusion of a sales contract with a trader from this online store. The Terms and Conditions of LuxuryChess.eu are binding for all users of the site. Any use of this website means that you have carefully read the Terms of Use and agree to comply with them unconditionally. Echarger Ltd. reserves the right to amend these Terms and Conditions at any time by updating them without prior notice. The features or prices of the products described on the site may be changed by LuxuryChess.eu at any time and may contain errors. The site may contain links to other websites, for which the company is not responsible regarding privacy policies or other information contained therein.

4. REGISTRATION

Registration on the website LuxuryChess.eu is voluntary and free of charge. Registration is not required to order products from the online store. Any client may place an order as a guest, using the "Guest Checkout" option – without registration. The site can be freely browsed without registration. Fields that are mandatory to fill in during registration are marked with an asterisk (*) in bright red color. Upon successful registration, the client receives a confirmation at the email address provided.

5. PERSONAL DATA

The personal data you provide on the website LuxuryChess.eu will be used solely for your service – processing orders, sending newsletters, and contacting you in case of problems related to your order. We guarantee that this data will not be unlawfully disclosed to third parties or used for purposes other than those described above. 6. GOODS

Only goods that the system allows to be added to the Customer’s Cart – according to the store’s operating mechanism – may be purchased through an electronic order from the site. All information regarding the goods offered for sale through the online store, including but not limited to product composition, sizes, and other details, is described by the manufacturer on the product labels.

7. PRICES

All prices presented on the website are VAT-inclusive. The company reserves the right to change them without notice. The prices of the goods presented in the online store are final and include VAT and all applicable taxes and fees under current Bulgarian and European legislation, excluding the delivery price.

8. ORDERS

Orders may be placed by any client of the website. To place an order, the user agrees to the Terms and Conditions of the online store LuxuryChess.eu and the Privacy Policy. Delivery times depend on the courier company the company works with. Delivery options may be changed by the company at any time.

9. COUPONS AND VOUCHERS FOR PROMOTIONS, DISCOUNTS, AND SALES

The company has the right to launch promotions on products offered in the online store LuxuryChess.eu with a validity period or until quantities are exhausted, as well as to terminate promotions at any time without notice. The company may also offer personalized coupons or discount codes to users and clients of the online store.

10. PAYMENT

Payment for orders from the online store LuxuryChess.eu may be made in several ways, in Bulgarian leva, according to the customer’s choice.

I. Cash on Delivery (Postal Money Transfer – PMT)

The user must pay the price of the ordered products plus the delivery cost to the courier upon receipt of the goods. The user receives with the goods a cash receipt and a document indicating the ordered product, its price, and the delivery price. When paying by Cash on Delivery, the buyer hands over to the courier the total due amount (including the order and delivery price), which is recorded in the acceptance-transfer slip serving as a receipt. By signing this slip, the client authorizes the courier to transfer the sum to the company on their behalf.

II. Bank Transfer

The website user may request to pay for the ordered goods via bank transfer. The company may provide its bank account details to the client upon request. Order processing begins once the funds are successfully transferred to the company’s bank account.

III. Card Payment

You may pay online during the order process with your Maestro, Visa, or MasterCard debit or credit card. In the event that the customer cancels a purchase within 14 days of receipt and the goods were paid for by card, the refund will be issued only to the same card used for payment.

The supplier never stores credit/debit card data used by the user when purchasing from LuxuryChess.eu. The user may choose to save their card details for future use, but such data is stored only by the issuing bank’s system, not by the supplier.

11. ORDER CANCELLATION

In the event of cancellation, the client must return the purchased goods, covering the transportation costs for the return. The goods must be in their original intact packaging, with labels, unused, and accompanied by all received documents, including the cash receipt. The purchase amount will be refunded to the client’s bank account provided by them.

Please note that stock availability shown on our online store is not directly linked to our warehouse system. Ordered products may be out of stock. The company reserves the right not to fulfill an order if the goods are unavailable. If advance payment was made by debit or credit card for an out-of-stock product, the sum will be refunded to the customer’s bank account.

12. SECURITY

For security purposes, the connection between LuxuryChess.eu and its users and clients is encrypted.

13. CONTRACT

The distance sales contract between the company and the client is considered concluded from the moment the company confirms the specific order. When an order is placed, the client receives an email confirmation. Before dispatching the ordered goods, the company may contact the client by phone to clarify order and/or delivery details. The company reserves the right not to fulfill an order if the goods are unavailable. The company is not responsible for failure to fulfill an order if the client has provided false, incomplete, or inaccurate personal data, including an incomplete, incorrect, or fictitious address or phone number.

If the client chose to pay by Cash on Delivery, the contract is considered canceled if: - The client does not pay the courier at delivery. - The client provided an incorrect or inaccurate address, or is absent at the address on the delivery day and does not answer the contact phone numbers to arrange delivery with the courier.

14. WARRANTY CONDITIONS

The company provides a warranty document to its customers for purchased goods, if such a document is issued by the manufacturer or importer. The document includes: the address and phone number of authorized service centers, warranty conditions of the respective centers or manufacturers, and the warranty period of the purchased goods.

We expressly inform users and clients that the seller (the company) is not the manufacturer of the products offered in our online store and bears no liability for defective products. Therefore, in case of a defect, the user may seek responsibility only from the manufacturer.

Warranty exclusions include: Improper use of the product. Poor installation or maintenance by the customer. Unauthorized repairs, modifications, or changes. Modifications by someone other than the manufacturer. Corrosion/rust due to constant moisture/water. Non-compliance with manufacturer’s instructions. Environmental damage (humidity, heat, power surges, dust, etc.). Products returned broken, damaged, or in improper packaging. Use in wet/outdoor environments if not explicitly allowed. Accidents or force majeure (lightning, fire, flood, etc.). Neglected safety measures. Physical force (impact, fall, crushing). Markings with ink or other substances. No warranty for damage caused to third parties.

In case of a warranty claim, the client must notify the company in writing, describing the defect in detail and, if possible, attach photos, as well as the invoice for payment. In justified cases, the company undertakes to contact the manufacturer and replace the goods as soon as possible. If replacement is required, ownership of the defective product is transferred back to the company upon return, and the new product becomes the customer’s property. Repairs can only be carried out by the manufacturer.

15. DELIVERY OF THE ORDERED GOODS

Delivery of goods ordered through the online store is carried out by courier or by a company employee. Deliveries are made only within the geographical territory of Bulgaria and EU member states if DPD, the company’s partner courier, provides service there. Upon delivery, the recipient signs a delivery note as proof of proper order execution. In exceptional circumstances, the company reserves the right to extend delivery times, informing the customer in due course. Goods are delivered to recipients in person against signature. If the parcel cannot be delivered through no fault of the company or courier, the courier contacts the client by phone to arrange collection from a courier office. If contact cannot be established and delivery is impossible, the distance sales contract is automatically terminated.

16. UNCLAIMED AND UNACCEPTED PARCELS

Unclaimed parcels at a courier’s office or undelivered parcels to the customer’s address within 14 business days from dispatch, which have not been prepaid and are refused or not collected by the client for any reason, are considered canceled orders. The company will retrieve them from the courier.

17. RETURNS AND COMPLAINTS

According to the Consumer Protection Act, you have the right to return any product ordered from LuxuryChess.eu no later than 14 calendar days after receipt. To return a product, it must be sent back in its original intact packaging, with labels, unused, and accompanied by all received documents, including the cash receipt.

The return costs are borne by the client. Products may also be returned in person at the company’s office. Refunds are made within 14 calendar days from the date the returned goods are received, via bank transfer (you must provide bank name, IBAN, BIC, and account holder’s name) or to the same card used for payment if purchased with a debit/credit card. The client is entitled only to the value of the returned goods, as it was at the time of order.

If these conditions are not met, the company reserves the right to refuse the return and not issue a refund. IMPORTANT: Art. 103v of the Consumer Protection Act: In contracts where the trader sends goods to the consumer, the risk of loss or damage passes to the consumer once the consumer or a designated third party (other than the carrier) accepts the goods.

19. RESTRICTIONS

Users are not allowed to engage in actions that violate generally accepted communication and behavior rules, perform malicious actions, spread viruses, or otherwise violate or harm the rights and interests of third parties. They are not allowed to maliciously place orders on behalf of other persons without their consent. Users may freely use the resources of the website, except as restricted in these Terms and Conditions or by general legal limitations. Users may not distribute pornographic materials, copyrighted materials belonging to others, calls for violent changes of civil or social order, unlawfully obtained information, or any content infringing property or non-property rights of third parties.
